LEGISLATION NEWS
In April 2015, Official Journal of Romania republished the Civil Procedure Code of Romania, renumbering certain articles and paragraphs.
Important normative acts were modified this month, including the Tax Code, two regulations concerning judicial organization (the Regulation on evaluation of professional activity of judges and prosecutors and the Regulation on the organization and functioning of the Superior Council of Magistracy) and the Police Statute.
HIGH COURT OF CASSATION AND JUSTICE DECISIONS
As a result of Romania’s High Court of Cassation and Justice activity, Official Journal of Romania published 2 decisions regarding motions of appeal in the interest of the law, settling legal issues concerning certain provisions of Article 399 of the Criminal Procedure Code of Romania (“Preventive measures”) and of the Government Ordinance no. 18/2009 on organizing and financing residency stage.
Official Journal of Romania also published several High Court of Cassion and Justice decisions regarding preliminary rulings to settle legal issues, concerning certain provisions of the Criminal Code of Romania (Article 4 – “Applicability of the law in decriminalization”, Article 196 – “Bodily harm with basic intent”), Article 426 of the Criminal Procedure Code of Romania (“The cases of challenge for annulment”), Article 1.528 of the Civil Code of Romania (“Executing the «to do» obligation”) and related provisions.
ROMANIA’S CONSTITUTIONAL COURT DECISIONS
As a result of the Constitutional Court's activity, several decisions of unconstitutionality have been published in the Official Journal of Romania, regarding certain provisions of Article 5491 of the Criminal Procedure Code of Romania (“Procedure for forfeiture or invalidation of a document when a case is closed’), of Article 66 of the Government Emergency Ordinance no. 66/2011 on prevention, ascertainment and sanctioning of irregularities concerning granting and using European funds, and of the Law no. 14/2003 on Political Parties.
