Abstract

In November 2017, certain amendments were enforced regarding several legal acts, such as Law
no. 227/2015 regarding the Fiscal Code, The National Education Law no. 1/2011, Law no.
550/2004 on the organization and functioning of the Romanian Gendarmerie, Law no. 263/2010 on
the public pension unitary system, G.E.O. no. 6/2009 on the establishment of the guaranteed
minimum social pension, Law no. 411/2004 on privately managed pension funds, G.E.O. no.
9/2017 regarding certain budgetary measures in the year 2017, the extension of certain deadlines, as
well as the amendment and supplement of certain legal acts, G.E.O. no. 111/2010 on parental leave
and child care monthly allowance, Law no. 196/2016 regarding the minimum inclusion income,
Law no. 223/2015 on state military pensions, Law no. 62/2011 on social dialogue.
Moreover, several legal acts were issued, such as: OMJ no. 2792/2017 on the approval of the
Regulation on the organization and development of the exam or contest to acquire the capacity as
trainee notary, Law no. 207/2017 on the approval of the G.E.O. no. 56/2017 regarding the
supplement of art. II of Law no. 152/2017 on the approval of the G.E.O. no. 99/2016 regarding
certain measures for the remuneration of the staff paid from public funds, the extension of certain
deadlines, as well as certain fiscal and budgetary measures, Decision of the Constitutional Court
of Romania no. 2/2017 on the enforcement of the service procedure by publication in the
proceedings before the Constitutional Court, the Regulation on the organization and development of
the exam or contest to acquire the capacity as trainee notary of 19 October 2017, approved by the
OMJ no. 2792/2017, Government Decision no. 788/2017 to supplement the Government
Decision no. 294/2015 on the approval of the National Program for cadastre and land register
2015-2023, Decision no. 3/2007 of the Congress of the National Union of Insolvency
Practitioners from Romania regarding the approval of the Status on the organization and exercise
of the profession of insolvency practitioner and of the Code of professional ethics and discipline of the
National Union of Insolvency Practitioners from Romania.

În M. Of. nr. 885 din 10 noiembrie 2017, a fost publicată Legea nr. 211/2017 privind modificarea şi completarea art. 111 din Legea educației naționale nr. 1/2011.

În continuare, vom prezenta modificările aduse Legii nr. 1/2011 prin Legea nr. 211/2017.

Articol unic din Legea nr. 211/2017

Potrivit articolului unic, art. 111 din Legea educaţiei naţionale nr. 1/2011, publicată în M. Of. al României, Partea I, nr. 18 din 10 ianuarie 2011, cu modificările şi completările ulterioare, se modifică şi se completează după cum urmează:

Art. 111 alin. (5) din Legea educației naționale nr. 1/2011 (modificată prin Legea nr. 211/2017)

Vechea reglementare

În vechea reglementare, art. 111 alin. (5) prevedea faptul că:

„(5) Consiliul judeţean/Consiliul General al Municipiului Bucureşti asigură fonduri pentru organizarea şi desfăşurarea olimpiadelor şi a concursurilor şcolare judeţene/ale municipiului Bucureşti”.

Noua reglementare

Potrivit noii reglementări, la art. 111, alin. (5) se modifică și va avea următorul cuprins:

„Art. 111

(5) Consiliul judeţean/Consiliul General al Municipiului Bucureşti asigură fonduri pentru organizarea şi desfăşurarea olimpiadelor şi a concursurilor şcolare judeţene/ale municipiului Bucureşti, precum şi pentru acordarea stimulentelor financiare elevilor care au obţinut distincţii, medalii şi premii speciale şi cadrelor didactice care s-au ocupat de pregătirea acestora”.

Noua reglementare

Potrivit noii reglementări, la art. 111, după alin. (5) se introduce un nou alineat, alin. (5ˆ1), cu următorul cuprins:

„(5ˆ1) Cuantumul stimulentelor financiare prevăzute la alin. (5) se acordă în baza unui regulament aprobat prin hotărâre a consiliului judeţean/Consiliului General al Municipiului Bucureşti”.
